Welcome to Emirhan Baskaya's Transfer Playlist for My Music (the "App"). By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.
Changes to Terms
We reserve the right to modify, update, or replace these Terms at any time. Any changes will be effective immediately upon posting on this page. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
Use of the App
Emirhan Baskaya grants you a personal, non-exclusive, non-transferable, limited license to use the App for your personal, non-commercial use, subject to these Terms. You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App.
User Account
To use certain features of the App, including connecting to music streaming platforms and accessing premium subscription services, you may be required to authenticate through third-party music services (such as Spotify, Apple Music, YouTube Music, Deezer, Tidal, and others) using their official OAuth systems. You are responsible for maintaining the security of your connected accounts and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
Subscription and Payments
The App offers premium subscription plans (weekly and yearly) that provide access to additional features such as unlimited playlist transfers and support for all platforms. By purchasing a subscription, you agree to the pricing and payment terms presented at the time of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions through your Apple App Store account settings.
Playlist Transfer and User Responsibility
The App allows you to transfer playlists between music streaming platforms by reading playlist metadata (such as song titles, artist names, and album names) from a source platform and matching them on a destination platform. You are solely responsible for ensuring that your use of the App complies with the terms of service of each connected music platform. You agree not to use the App to:
- Transfer, copy, or distribute copyrighted audio files or recordings
- Circumvent any digital rights management or access controls of music platforms
- Violate any applicable local, national, or international laws
- Infringe upon the intellectual property rights or any other rights of third parties
- Automate bulk operations beyond normal personal use
Music Platform Integrations
The App connects to third-party music streaming platforms through their official APIs and OAuth authentication. Emirhan Baskaya does not control these platforms and is not responsible for their availability, content, or any changes they make to their services or APIs. Your use of each music platform is subject to that platform's own terms of service and privacy policy. The App only transfers playlist metadata and does not copy, download, or redistribute any audio content.
YouTube API Services
The App uses YouTube API Services. By using our App, you agree to be bound by the YouTube Terms of Service. You can review Google's Privacy Policy for more information on how Google handles your data. You can revoke the App's access to your YouTube account via Google Security Settings.
Intellectual Property
The App and its original content, features, and functionality are owned by Emirhan Baskaya and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. All music content, song titles, artist names, album artwork, and related metadata belong to the respective rights holders and music platforms.
Transfer Accuracy
The App matches songs across platforms using metadata such as song titles and artist names. Due to differences in music catalogs between platforms, not all songs may be found or matched correctly on the destination platform. We do not guarantee 100% accuracy or completeness of playlist transfers.
Limitation of Liability
Emirhan Baskaya, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; (iv) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through the App by any third party; (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content transferred via the App; (vi) any issues arising from third-party music platforms, APIs, or service availability; (vii) incomplete or inaccurate playlist transfers due to differences in music catalogs; or (viii) any changes to third-party platform APIs or terms that affect the App's functionality, whether based on warranty, contract, tort, or any other legal theory.
Indemnification
You agree to defend, indemnify, and hold harmless Emirhan Baskaya and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from (i) your use of and access to the App; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; (iv) your violation of any music platform's terms of service; or (v) any claim that your use of the App caused damage to a third party.
Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis. Emirhan Baskaya makes no warranties, expressed or implied, regarding the App's operation, availability, transfer accuracy, or the information, content, or materials included therein. To the fullest extent permissible by applicable law, Emirhan Baskaya disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. We do not guarantee uninterrupted access to the App, as the service depends on third-party APIs which may change or become unavailable.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease and any connected platform authorizations will be revoked.
